Is your 90 day trial period correctly worded?

We advise all clients to include a 90 day trial period in the employment agreements for new employees who have not worked for your company before.
A recent decision of the Employment Relations Authority* means that the employment contract needs to clearly specify when the 90 day trial period begins. The decision says that this could be at the commencement of the employment, the first day of training, or the first day of work.
This may involve inserting just one sentence into your employment agreement to the effect that the 90 day trial period begins on the Commencement Date. Contact us and we can make that quick change for you.

*This decision may be contentious and could be appealed, but for now, it remains in place. Given that requirements for trial periods are strictly enforced, this decision currently needs to be applied.
